OSHA Kicks Off New Summer Job Safety Campaign for Teen Workers

Teen workers are the target of a recently launched OSHA campaign that focuses on industries in which young people are likely to work during their high school and college years. The multi-year Teen Summer Job Safety Campaign is designed to increase awareness about workplace hazards among young workers and their parents and provide possible solutions to those hazards. A kit supporting this year's campaign theme, "Landscaping – Plant Your Feet on Safe Ground," is available for download.

AIHA Submits Comments on Occupational Safety Fairness Act

The American Industrial Hygiene Association (AIHA) recently submitted comments to Sen. Michael Enzi, R-Wyo., on Senate Bill 2066, the Occupational Safety Fairness Act, one of three bills introduced by Sen. Enzi recommending changes to OSHA. Additions and changes to the language were suggested in several sections to improve clarity. AIHA also commented on provisions in the act that would expand inspection methods, extend time available for contesting citations, and adopt non-governmental standards.

Survey Reveals Most Companies Already Preparing for Flu Pandemic

In a recent survey of ORC Worldwide member companies, 38 of 39 respondents reported they have developed, or are in the process of developing, an influenza pandemic preparedness plan. Most participating organizations indicated the intent to use a quarantine or some other form of engineering control in the event of a pandemic. All of the companies reported they are working on an influenza pandemic-related communication plan, with information sent via the Web, flu-related education, and business continuity plans as the most commonly mentioned tactics. Only 12 respondents mentioned they have or are in the process of purchasing Tamiflu for employees.

I was informed that we are supposed to be archiving obsolete MSDS pages for 30 years. Is this true?

Answer:

Maintaining obsolete material safety data sheets (MSDSs), those associated with hazardous materials no longer in inventory, is one means of complying with OSHA's Access to Employee Exposure and Medical Records regulation found in 29 CFR Part 1910.1020.

 

Archived MSDSs are considered employee exposure records, in that they represent a history of hazardous materials usage and provide data indicating that the materials posed a hazard to human health. When employed as worker exposure records, MSDSs must be maintained for "at least 30 years." Thereafter, an employer must notify the director of the National Institute for Occupational Safety and Health (NIOSH) in writing of the impending disposal of preserved MSDSs at least three months prior to their disposal.

 

 

As an alternative, an employer may discard obsolete MSDSs if a record is created and maintained for the 30-year retention period that includes the following information:

 

1. The identity of the hazardous material, including ingredient chemical names if available.

2. Information on where and when the hazardous material was used.

 

Obviously, this approach provides substantially more useful information than a collection of MSDSs. Acceptability of these two approaches was quite purposeful, resulting from a desire to provide employees with access to meaningful exposure records and a simultaneous desire to minimize employer objections to this standard during the rulemaking process. In either case, employers have an annual obligation to inform employees of the existence, location and availability of relevant employee exposure records, regardless of their format.

Sampling Unit
